Introduction

Welcome to VoxTori. These Terms of Service ("Terms") govern your use of VoxTori, a macOS application that provides real-time speech recognition and translation services ("Service"). By downloading, installing, or using VoxTori, you agree to be bound by these Terms.

Please read these Terms carefully before using VoxTori. If you do not agree to these Terms, do not use the Service.

Description of Service

VoxTori is a macOS application that provides:

  • Real-time speech recognition and transcription

  • Real-time translation between supported languages

  • Live subtitle overlay display

  • Quick voice-to-text capture functionality

  • Transcript history management

The Service processes audio and provides transcription and translation primarily on your device. An optional Enhanced Mode feature may use cloud-based services for speech recognition when enabled.

Eligibility

You must be at least 4 years of age to use VoxTori. By using the Service, you represent and warrant that you meet this age requirement.

Account and Registration

VoxTori does not require account registration or login. You may use the Service immediately upon installation without providing any personal information.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use VoxTori on macOS devices that you own or control, solely for your personal, non-commercial use.

Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Service

  • Reverse engineer, decompile, or disassemble the Service, except as permitted by applicable law

  • Use the Service for any unlawful purpose or in violation of any applicable laws

  • Attempt to gain unauthorized access to any portion of the Service

  • Use the Service to infringe upon the intellectual property rights of others

  • Use the Service to transcribe or translate content without proper authorization

  • Remove, alter, or obscure any proprietary notices in the Service

  • Use the Service in any manner that could damage, disable, or impair the Service

Subscription Plans and Payments

Free Tier

VoxTori offers a free tier with limited features, including:

  • Limited daily usage time

  • Limited transcript history storage

  • Core transcription and translation features

Pro Subscription

VoxTori Pro is available through the following subscription options:

  • Monthly subscription

  • Annual subscription

  • Lifetime purchase (one-time payment)

Pro features include:

  • Unlimited usage time

  • Unlimited transcript history

  • Enhanced Mode access

  • All premium features

Payment and Billing

All payments are processed through the Apple App Store. By subscribing to VoxTori Pro, you agree to:

  • Pay all applicable fees as described at the time of purchase

  • Apple's App Store terms and conditions for in-app purchases

  • Automatic renewal of subscriptions unless cancelled before the renewal date

Cancellation and Refunds

  • You may cancel your subscription at any time through your Apple ID account settings

  • Cancellation takes effect at the end of the current billing period

  • Refund requests are subject to Apple's App Store refund policies

  • Lifetime purchases are non-refundable except as required by applicable law

Intellectual Property

Ownership

VoxTori and all related intellectual property rights are owned by us or our licensors. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

Your Content

You retain ownership of any content you create using VoxTori, including transcripts and translations. We do not claim any ownership rights over your content.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, worldwide, royalty-free license to use such feedback for any purpose without compensation to you.

Third-Party Services

Apple Services

VoxTori integrates with Apple's services for certain functionality:

  • Speech recognition (on-device and, when Enhanced Mode is enabled, cloud-based)

  • Translation services

  • App Store for subscription management

Your use of these Apple services is subject to Apple's terms and conditions.

Language Packs

Certain features require downloading language packs through macOS System Settings. Availability and functionality of language packs are subject to Apple's terms and system requirements.

Disclaimers

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Accuracy

We do not warrant that:

  • Transcriptions or translations will be accurate, complete, or error-free

  • The Service will meet your specific requirements

  • The Service will be uninterrupted, timely, secure, or error-free

  • Any errors in the Service will be corrected

Use at Your Own Risk

You acknowledge that speech recognition and translation are inherently imperfect technologies. You should not rely solely on VoxTori for critical communications, legal matters, medical decisions, or any situation where inaccurate transcription or translation could cause h

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless VoxTori and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Any content you create or share using the Service

Termination

Termination by You

You may stop using VoxTori at any time by uninstalling the application. If you have an active subscription, you should cancel it through your Apple ID account settings.

Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

Effect of Termination

Upon termination:

  • Your license to use the Service immediately terminates

  • You must cease all use of the Service

  • Provisions that by their nature should survive termination will survive

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the app

  • Updating the "Last Updated" date at the top of these Terms

  • Providing notice through the app when significant changes are made

Your continued use of VoxTori after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VoxTori regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VoxTori operates, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
